Privacy Policy

MKennedy Forensic Experts respects your privacy. This policy explains what personal information we collect through this website and our communications, how we use it, who we share it with, and the choices and rights you have. Our services are professional services directed to businesses, attorneys, and insurance professionals in the United States.

1. Information we collect

Information you give us directly. - Contact form or email: your name, firm or company, email address, phone number if you provide it, and your description of the matter. - Damages Roadmap: if you request access to our Damages Roadmap tool, we collect your name, firm, work email address, and professional role, along with the selections you make in the tool. The roadmap you generate is emailed to you and a copy, including your name and selections, is sent to us. - Correspondence: the content of emails and replies you send us. - AI website assistant: if you use the chat assistant on this site, we collect the messages you type and the assistant’s replies. Chat conversations are logged. See Section 5 for full details.

Please do not include confidential, privileged, or claim-specific details in an initial inquiry. A conflict check must be completed before any engagement begins, and submitting a form or sending an email does not create a professional relationship.

Information we collect from other sources. For our professional outreach we maintain business contact information (name, firm, professional email address, business phone, and business address) obtained from our own business records, professional directories, industry contacts, and publicly available professional sources. This is business contact data about professionals in their professional capacity. Every outreach email we send includes a working unsubscribe link.

Information collected automatically. Our hosting provider processes standard technical logs (such as IP address, browser type, and pages requested) to operate and secure the site. If you use the chat assistant, we also record your IP address and browser type with your chat session to prevent abuse and enforce usage limits. This website sets no cookies, runs no analytics, and contains no advertising trackers or tracking pixels. The chat assistant keeps a copy of your conversation in your own browser’s local storage for up to 24 hours so the conversation persists as you browse; that copy stays on your device and you can clear it through your browser at any time. Our outreach emails contain no open-tracking or click-tracking pixels.

2. How we use your information

We use personal information to: - respond to your inquiry and communicate with you; - run conflict checks before accepting an engagement; - provide the Damages Roadmap and deliver your copy of the report; - operate the AI website assistant, generate its responses, enforce usage limits, prevent abuse, and review logged conversations for quality and security; - maintain records of inquiries and professional contacts in our client relationship management system; - send professional outreach and, where you have engaged with us, follow-up communications, each with an unsubscribe option; - comply with legal, professional, and record-keeping obligations, and protect our legal rights.

We do not use personal information for automated decision-making that produces legal or similarly significant effects, and we do not use it for targeted advertising.

3. How we share information

We do not sell personal information, and we do not share it for targeted advertising. We share personal information only with:

  • Service providers that operate this website and our communications under contractual confidentiality obligations: website hosting, security, and chat data storage (Cloudflare), AI response generation for the website assistant (Anthropic), transactional email delivery (Resend), client relationship management (HubSpot), outreach email delivery, and our email security providers. Each processes data only to provide its service to us.
  • Professional obligations and legal compliance: where disclosure is required by law, subpoena, court order, or applicable professional standards, or to protect the rights, safety, or property of MKFE or others.
  • Business transfers: if MKFE is ever merged, acquired, or reorganized, records may transfer as part of that transaction under the same protections.

4. Confidentiality and professional obligations

Information shared during an engagement is governed by the engagement letter and applicable professional standards, including CPA confidentiality obligations, which impose stricter duties than this policy. Where work relates to litigation, information may also be subject to court orders and applicable privilege and work product protections. Nothing in this policy limits those stricter obligations.

5. AI website assistant

This site offers a chat assistant so visitors can get quick answers about the firm. Before you use it, understand the following:

  • It is an AI assistant, not a person. It is labeled as such in the chat window. Its replies are generated by artificial intelligence (Anthropic’s Claude model), are general information only, may contain errors, and are not accounting, legal, tax, insurance, or financial advice. No statement it makes is a professional opinion of Matthew Kennedy or MKFE.
  • Conversations are logged and are not confidential. The messages you type and the replies you receive are recorded, along with your IP address and browser type, and may be reviewed for quality, security, and abuse prevention. Do not share confidential, privileged, or claim-specific information in the chat.
  • Using the chat creates no professional relationship. No client relationship, engagement, or duty of any kind is formed by chatting with the assistant. Engagements begin only after a conflict check and a written engagement letter.
  • How it is processed. Your chat messages are sent to Anthropic to generate each response and stored with our hosting provider (Cloudflare). We do not use chat conversations to train AI models, and we apply usage limits to prevent abuse.

6. Data retention

We keep inquiry correspondence and contact records for as long as reasonably needed for conflict checking, business records, and professional record-keeping obligations, then delete or anonymize them. Engagement records are retained per the engagement letter and applicable professional standards. Unsubscribe records are kept permanently so your opt-out stays honored. Chat assistant logs are kept for as long as reasonably needed for quality review, security, and abuse prevention, then deleted or anonymized.

7. Security

We use commercially reasonable technical and organizational safeguards, including encrypted connections (HTTPS) on every page of this site, access controls on our systems, and reputable U.S.-based service providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Email choices

Every marketing or outreach email we send identifies MKFE as the sender, uses a truthful subject line, includes our physical mailing address, and contains a working unsubscribe link, consistent with the CAN-SPAM Act. We honor unsubscribe requests promptly, and in all cases within ten business days. You can also opt out any time by emailing kennedy@mkfe.us with “unsubscribe” in the subject line.

9. Your privacy rights

You may contact us at kennedy@mkfe.us to: - ask whether we hold personal information about you and request a copy; - correct inaccurate information; - request deletion, subject to conflict-check, legal, and professional record-keeping obligations; - receive the information you provided in a portable format.

We extend these rights to all individuals regardless of where you live. We will verify your request using the email address associated with your information and respond within 45 days. If we need more time, we will tell you why and respond within a further 45 days. We will never discriminate against you for exercising a privacy right.

Appeals. If we decline a request, you may appeal by replying to our decision with “appeal” in the subject line. We will respond to an appeal within 60 days with a written explanation. If you are not satisfied, you may contact your state attorney general; residents of Texas may contact the Texas Attorney General at texasattorneygeneral.gov.

State-specific notes. Some state privacy laws (including in California, Texas, Virginia, Colorado, Connecticut, and Utah) grant specific rights, subject to those laws’ applicability thresholds. Because we do not sell personal information or use it for targeted advertising or profiling, there is nothing to opt out of under those provisions; the access, correction, deletion, and portability rights above are available to everyone. California residents: the categories of personal information we have collected in the last 12 months are identifiers and professional information as described in Section 1; we have not sold or shared personal information.

Global Privacy Control and Do Not Track. Because this site sets no cookies and performs no tracking or sale of personal information, there is no tracking activity for GPC or Do Not Track signals to affect.

10. Children

This website and our services are directed to professionals and are not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided us personal information, contact us at kennedy@mkfe.us and we will delete it.

11. Visitors outside the United States

Our services are directed to the United States and information is processed on servers in the United States. If you contact us from outside the U.S., you understand your information will be processed in the U.S.

12. Changes to this policy

We may update this policy from time to time. The current version, with its effective date, will always be posted at this page. Material changes will be reflected in an updated “Last updated” date.
